SUBJECT: LEGISLATIVE DECREE 196/03 -
Personal data protection code (PRIVACY): INFORMATION ABOUT ART.13 AND
REQUEST OF APPROVAL TO PROCESS DATA.
Reason for data processing
We would like to inform you that the legislative decree no. 196 dt.
June, 30th 2003 regulates the code on personal and company protection
on data processing.
According to the a.m. decree, the processing of your data will be based
on correctness, permissivity and transparency, and protection of your
privacy and rights.
The data you will supply to us, exclusively general information, will
be processed to comply with legal, civil and fiscal norms connected to
the contracts and the relevant legal and contractual obligations, which
may arise consequantly. The supplied data will as well be used to
effectively manage contracts and commercial relations, to send
commercial and updated information or advertisement materials.
Processing method
The supplied data will be processed in writing and on magnetic,
electronic or telematic means as well as on any other suitable medium.
Data communication and consequent refusal of data.
The data supply is necessary as regulated on legal and contractual
obligations. Therefore denying to supply it could prevent the consignee
to fulfill the contract.
On the contrary, if the supply is denied for data not related to legal
and contractual obligations every time the destinee will evaluate and
consequently decide how to proceed, according to the role played by the
required data in the commercial relationship.
Possible destinee of personal data
The supplied data can be transmitted to consultants, professionals and
data processing centers for pure accounting and fiscal reasons.
Moreover, it could be transmitted to: forwarders, pubblic
administration offices and authorities, according to the legislations;
credit institutions having financial relationship with our company; all
fisical and juridical persons, as well as private or pubblic structures
(legal, company, administration and fiscal consultants, administration
of the Court, Chamber of Commerce etc.), every time this is necessary
for our acitivity.
Right of the subject person (art.7)
Art. 7 of this law grants you, as its subject, specific rights like:
the possibility to request a confirmation of the existence of your
personal data or not and its intelegible availability; to know the
origin of data as well as the logic and reason of the processing; or to
ask for cancellation, modification to anonimous form or the veto on
data processing against the law, as well as the updating, correction or
in case of interest, the completion of them; and the right to refuse
the processing for legitimate reasons.
